Scope of CA Notice

This Supplemental California Privacy Notice (“CA Notice”) supplements the information contained in the Privacy Notice, but unlike the Privacy Notice, this CA Notice is not limited to the processing of Personal Information in connection with your use of this website and your interactions with us regarding your interest in the Residences. This CA Notice describes how we collect, use, disclose, and otherwise process Personal Information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 (“CCPA”), including in connection with the actual purchase of a Residence. In connection with your consideration to become a resident of the Residences, we will also separately provide you with additional notices about the Residences, as required by law.

This CA Notice does not, however, describe how Four Seasons Hotels and Resorts collects, uses, discloses, or otherwise processes Personal Information of prospective or actual owners or guests of the Residences. Please consult the Four Seasons Privacy Notice for information about Four Seasons’ collection, use, disclosure and other processing of Personal Information.

Unless otherwise expressly stated, capitalized terms in this CA Notice have the same meaning as defined in the Privacy Notice.

Personal Information Disclosure

When we use the term “Personal Information” in this CA Notice, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. It does not include aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you.

Collection, Disclosure, and Sale of Personal Information

In the last twelve (12) months, we have collected and disclosed for a business purpose the following categories of Personal Information

Sources of Personal Information

As described in the Our Collection and Use of Personal Information section of the Privacy Notice, we collect Personal Information directly from you when you provide it to us, automatically when you interact with our website or emails, and from business partners, service providers, information providers and publicly available sources.

Purposes for Collecting Personal Information

We collect Personal Information about you for the purposes described in the Our Collection and Use of Personal Information section of the Privacy Notice, as well as to:
– facilitate your viewing of the Residences;
– assess your application to purchase a Residence;
– facilitate a transaction for your purchase of a Residence; and
– protect our interests in the Residences.

Recipients of Personal Information

As described in the Our Disclosure of Personal Information section of our Privacy Notice, we share Personal Information with Four Seasons and with a variety of third parties.

Your Privacy Rights

To Exercise Your Right to Know or Right to Deletion

To exercise your right to know and/or right to deletion if you are a California resident, please submit a request by:

We will need to verify your identity before processing your request. In order to verify your identity, we will generally either require the successful login to your account or the matching of sufficient information you provide us to the information we maintain about you in our systems.  Although we try to limit the Personal Information collected in connection with a request to exercise the right to know and/or the right to deletion to that Personal Information identified on the California Resident Rights Request Form, certain requests may require us to obtain additional Personal Information from you. In certain circumstances, we may decline a request to exercise the right to know and/or right to deletion, particularly where we are unable to verify your identity.

Minors Under Age 16

We do not sell the Personal Information of consumers we know to be less than 16 years of age, unless we receive affirmative authorization (the “Right to Opt In”) from either the minor who is between 13 and 16 years of age, or the parent or guardian of a minor less than 13 years of age.

“Shine the Light”

California’s “Shine the Light” law (Civil Code Section §1798.83) permits California residents that have an established business relationship with us to request certain information regarding our disclosure of certain types of Personal Information to third parties for their direct marketing purposes during the immediately preceding calendar year.

We will update this CA Notice from time to time. When we make changes to this CA Notice, we will change the “Effective Date” at the beginning of this CA Notice. If we make material changes to this CA Notice, we will notify you by email to your registered email address, by prominent posting on this website, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification.
